To quash the proceedings in Crime No.19 of 2023, the petitioner has approached this Court.

2.The learned counsel for the petitioner submits that the petitioner is a Village Administrative Officer. According to the petitioner, he has processed the application submitted for grant of patta in accordance with law. However, he has been added as an accused in the above case and therefore, it has to be quashed. 3.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the first respondent submits that the case in Crime No.19 of 2023 has been registered not only as against this petitioner but also as against the Tahsildar and the Sub Registrar. According to the learned Government Advocate, the investigation is in crucial stage and they are expecting to receive an expert opinion from the Forensic Department. On receipt of the report from the Forensic Department, final report would be filed within a period of three months.
4.This Court considered the rival submissions made and also perused the materials placed on record.

5.The petitioner claims that he, as a Village Administrative Officer, has processed the application, which was filed and placed before him for grant of patta. On the side of the respondents, it is averred that the case has been registered not only as against this petitioner, but also as against the Tahsildar and the Sub Registrar, who are also involved in the offence. The investigating officer is expected to conduct the investigation, considering the grounds raised by this petitioner in this petition. In the event, if the final report is filed as against the petitioner, it is always open to him to challenge the final report on the available materials.
6.This Court is not inclined to quash the proceedings at this stage, on the grounds raised by this petitioner. Accordingly, this Criminal Original Petition is closed.
