PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to permit the petitioner to remove the rough stones and waste soil from the petitioner's land comprised in S. No.415/5, measuring about 29 1/2 cents situated at Kaliyakkavilai Village, Vilavancode Taluk, Kanyakumari District by considering the 1/4

representation given by the petitioner dated 17.05.2022 and to pass such further or other orders as this Court.

The petitioner has submitted an application on 17.05.2022 seeking permission from the respondents to take rough stones and waste soil, which are available in the petitioner's land for his own usage and filed this writ petition on 25.07.2022 for a Mandamus to direct the respondents to permit the petitioner to remove the rough stones and waste soil from his land. 2.When this writ petition is taken up for hearing, there is no representation for the petitioner.

3.The learned Additional Government Pleader submits that if the petitioner has submitted an application in a prescribed format under Section 44 of the Tamil Nadu Minor Mineral 2/4

Concession Rules, 1959, the same would be considered within a period of 12 weeks from the date of submission of his application. 4.Recording the submission made by the learned Additional Government Pleader, this writ petition is closed. No costs.
