ORDER

The petitioners are accused No.1 and 2 in Crime No.514 of 2021 on the file of the first respondent Police which was registered for the 1/4

offence under Sections 147, 148, 294(b), 323 and 506(ii) of IPC. They have filed this application to quash the proceedings pending against them in Crime No.514 of 2021 on the file of the first respondent Police, on the ground that the issue has been amicably settled among themselves. 2.Mr.P.Kottai Chamy, learned Government Advocate (Crl.side) appearing for the first respondent Police and submits that the case in Crime No.514 of 2021 has been registered as a counter case. In this case, apart from two named accused, the case has been registered against ten others. However, the investigation agency is not in a position to find out the remaining accused. Therefore, the investigation is still pending. 3.

This Court is unable to understand the reasons given by the respondent Police that they are not in a position to find out the other accused for the past four years. Since the case in Crime No.514 of 2021 has been registered in the year 2021, the first respondent Police is directed to conclude the investigation in Crime No.514 of 2021 within a period of two weeks from the date of receipt of a copy of this order.

4.With the above observation, this criminal original petition is dismissed with liberty to the petitioners to move a fresh application along with the remaining accused, if settlement is arrived between all the parties.
