This Civil Miscellaneous Petition filed under Section 148 r/w 151 C.P.C. praying to extend time for depositing the entire award amount to the credit of M.C.O.P.No.234 of 2019 on the file of the Motor Accident Claims Tribunal (Special Judge for Forest Offence Cases), Nagercoil pending disposal of the above civil miscellaneous appeal.
ORDER
The above petition has been filed seeking orders to extend the time for depositing the entire award amount to the credit of M.C.O.P.No.234 of 2019 on the file of the Motor Accident Claims Tribunal (Special Judge for Forest Offence Cases), Nagercoil pending disposal of the above civil miscellaneous appeal.
2. It is seen from the records that this Court, while granting interim stay, has directed the petitioner to deposit 50% of the award amount to the credit of M.C.O.P.No.234 of 2019 within a period of four weeks from the date of receipt of a copy of that order, failing which, interim stay granted shall stand automatically vacated, without any reference to this Court.
3. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.
4. Considering the reasons assigned, this Court is inclined to extend time by two weeks. Accordingly, time is extended till 04.07.2025 for complying with the directions of this Court dated 28.03.2025 in C.M.P.(MD)No.5299 of 2025 in C.M.A. 2/4
(MD)No.296 of 2025. On such deposit, the first respondent / claimant is permitted to withdraw 25% of the amount that was deposited by the petitioner / third respondent on filing necessary application before the Tribunal.
