ORDER

The petitioner has filed this writ petition seeking direction to the respondent to renew his passport. 2.According to the petitioner, earlier a passport was issued to him on 25.03.2006 for a period of 10 years which expired on 24.03.2016 and he applied for renewal. The application of the petitioner for renewal was rejected by the respondent on the ground that a criminal case is pending against the petitioner in P.R.C.No.2 of 2016 on the file of the Judicial Magistrate No.1, Madurai for an alleged offence punishable under Sections 201, 409, 420, 468, 120(B), 109, 328 IPC and Section (3) (eea) and 27 of Drugs and Cosmetics Act. Hence, the petitioner has filed this writ petition.

3.Today, the respondent has filed a counter affidavit stating that since the above said criminal case is pending against the petitioner, his application for renewal of passport cannot be considered.

4.Learned counsel for the respondent would submit that if the petitioner submits copy of the order from the concerned court permitting him to travel abroad, his passport application will be https://hcservices.ecourts.gov.in/hcservices/

processed in accordance with the Indian Passports Act, 1967. 5.Learned counsel appearing for the petitioner would submit that the petitioner is willing to approach the Court concerned and file necessary application permitting him to travel abroad.

6.In view of the said submission, no further order is necessary in this writ petition. Accordingly, the writ petition is closed. However, it is always open to the petitioner to approach the concerned court for filing necessary application seeking permission to travel abroad, if he is so advised. No costs.
