To extend the time granted by this Honble Court by order dated 09.03.2023 in Crl OP(MD) No.7651/2022 for a period of two weeks. Order : These Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.C.MAYILVAHANA RAJENDRAN, Advocate for M/S.PARAMASIVAN.P, Advocate for the petitioners in CRL MP(MD) No.9860 of 2023 and of Mr.R.RAJESH, Advocate for the Petitioner in CRL MP(MD) No.9863 of 2023 and of Mr.S.MANIKANDAN, Government Advocate (Crl. side) on behalf of the Respondent No.1 in both petitions, the court made the following order:-- Crl.M.P.(MD).No.9860 of 2023, has been filed by the defacto complainant to cancel the order of anticipatory bail granted to the accused person in Crl.O.P.(MD). No.7651 of 2022 dated 09.03.2023 on the ground of non compliance of the above said 3/5
order. Crl.M.P.(MD).No.9863 of 2023, has been filed by the accused person, seeking extension of time to comply the above said order. 2.It was submitted that repeatedly, the accused person has filed extension of time applications. Even though repeatedly, the time was granted, he did not comply the condition imposed upon him while granting anticipatory bail. 3.There is a clause in the order to the effect that if the condition is not complied within the time stipulated, then the anticipatory bail granted to the petitioner should stand dismissed automatically. Therefore, the anticipatory bail granted to the petitioner is hereby cancelled. Accordingly, the petition filed by the defacto complainant in Crl.M.P.(MD).No.9860 of 2023 is allowed and petition filed by the accused person in Crl.M.P.(MD).No.9863 of 2023 seeking extension of time is dismissed.
