PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C. to call for the records relating to the charge sheet in S.S.C.No.40 of 2020, on the file of the I Additional District and Sessions Court for PCR Act Cases, Thanjavur, and quash the same as against the petitioner is concerned.

ORDER

This Criminal Original Petition has been filed seeking to quash the proceedings in S.S.C.No.40 of 2020, on the file of the I Additional District and Sessions Judge (PCR) Thanjavur.

2. Claiming benefit of quashment, which was granted in favour of the accused namely, Chezhiyan - A2 and Anbuchelvan - A3 in Crl.O.P.(MD).No.3869 of 2021, this petitioner, who is arrayed as accused No.2 has filed this present petition. The learned counsel for the 2/5

petitioner submitted that this petitioner is standing in the very same footing like that of the accused No.2 and 3.

3. Since the petitioners are standing on the very same footing, the very same benefit shall stand extended to him also.

4. Accordingly, this Criminal Original Petition is allowed. The proceedings in S.S.C.No.40 of 2020, on the file of the I Additional District and Sessions Judge (PCR) Thanjavur, is hereby quashed in respect of this petitioner/Accused No.4. Consequently, connected miscellaneous petition is closed.
