PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Declaration, declaring that Section 1(5) of the ESI Act, 1948 has no application and cannot be extended to the petitioner-religious society as ultra vires and void and violation of fundamental rights enshrined in Articles 25, 26 and 27 of the Constitution of India and forbearing the respondents to do any act contrary to the constitutional provisions by proceeding against the petitioner-religious society under the ESI Act, 1948.
