PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the Respondents 1 to 3 herein to conduct an enquiry to cancel the joint patta No.859 of the property in Survey No.12/2A, 12/2C to an extent of 36.39.50 (8 acre 96 cents) situated at Thirupuvanam Pudur Village, Tirupuvanam Taluk, Sivagangai District, by considering petitioner's representation dated 09.05.2026 and issue patta in favour of Arulmiku Siddhi Vinayagar Temple Trust, in accordance with law, within the time stipulated by this Court.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 herein to conduct an enquiry to cancel the joint patta No.859 of the property in Survey No.12/2A, 12/2C to an extent of 36.39.50 (8 acre 96 cents) situated at Thirupuvanam Pudur Village, Tirupuvanam Taluk, Sivagangai District, by considering petitioner's representation dated 09.05.2026 and issue patta in favour of Arulmiku Siddhi Vinayagar Temple Trust, in accordance with law, within the time stipulated by this Court.

2. The contention of the petitioner is that he is the devotee of the temple and a legal heir of the original owner of the property. According to the petitioner, a portion of the property was donated to the temple and the temple was created by the forefathers of the petitioner. It is further stated that the petitioner is presently maintaining the temple.

3. This Court without expressing any opinion on merits is directing the official respondents to consider the petitioner's representation dated 09.05.2026, after issuing notice to the petitioner and the rival claimants, if any and thereafter, pass appropriate orders in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
