Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents to rectify the wrong classification as Sarkaar Puramboke Lands and Road in Town Survey Numbers 17/2, 18/2, 19/3, 28/3, 27/4, 24/2 , 23/2 and 20/2 of Chathiramputhukulam Village made in revenue records and to restore in the name of Krishnamoorthy.

ORDER

The petitioner herein seeks a direction to the respondents to rectify the wrong classification as Sarkaar Pormboke in respect of the property situated in Town Surveys Numbers 18/2, 19/3, 28/3, 27/4, 24/2 , 23/2 and 20/2 at Chathiramputhukulam Village within the time stipulated by this Court.

2. Heard the learned counsel for the petitioner, Mr.M.Gangatharan, learned Additional Government Pleader, who takes notice for R1 to R3 and Mr.S.P.Maharajan, learned Standing Counsel who takes notice for R4. 2/6

3. By consent of both parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, the subject property originally stood in the name of the petitioner's partner Vinayak Shankar's father Krishnamoorthy in Patta No.272 and 1769. During the preparation of Town Survey Register, the subject property was wrongly reclassified as Sarkaar Pormboke. Immediately after acquiring knowledge about the same, the petitioner submitted a representation before the 1st and 2nd respondents on 18.09.2024, seeking correction of the classification in the Town Survey Register as 'Ryotwari' instead of 'Sarkar Poramkoke'. The same has not been considered. Hence, the petitioner has come before this Court.

5. The learned Additional Government Pleader, who takes notice for R1 to R3 would submit that the representation submitted by the petitioner dated 18.09.2024 will be considered on its own merits and in accordance with law within the time stipulated by this Court. 3/6

In view of the same, without expressing any opinion on the merits of the matter, the 1st respondent is directed to forward the representation of the petitioner dated 18.09.2024 to the competent authority viz., the District Collector, Tirunelveli within a period of two (2) weeks from the date of receipt of a copy of this order. The District Collector, Tirunelveli shall consider the representation of the petitioner dated 18.09.2024 and pass final orders on its own merits and in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the other interested parties if any.

7. The writ petition stands disposed of with the above observations. No costs.
