PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to pay the wages from the date of suspension in Rc.No.A6/3186/2016 to till the date of joining into the service ie., 22.08.2017 to 07.05.2018 respectively on the basis of revocation of suspension order passed in the final order by the 2nd respondent in Na.Ka.No.M1/12465/2017 dated 03.04.2018 which was served to the petitioner on 27.04.2018 and granting such further or other relief.

ORDER

The Writ Petition has been filed praying to issue a Writ of Mandamus, directing the 2nd respondent to pay the wages from the date of suspension in Rc.No.A6/3186/2016 to till the date of joining into the service ie., 22.08.2017 to 07.05.2018 respectively on the basis of revocation of suspension order passed in the final order by the 2nd respondent in Na.Ka.No.M1/12465/2017 https://hcservices.ecourts.gov.in/hcservices/

dated 03.04.2018 which was served to the petitioner on 27.04.2018.

2. It is represented that the petitioner was placed under suspension and the same has been revoked and the petitioner is in service. The petitioner has stated that he preferred an appeal and the appeal may be directed to be considered by the appropriate authority within a stipulated period to be fixed by this Court.

3. In the light of the above submission, the appropriate authority is directed to consider the appeal filed by the petitioner within a period of four months from the date of receipt of a copy of this order. In case of any adverse order, it is open to the petitioner to approach the Authority, under the payment of Subsistence Allowance Act, claiming payment of subsistence allowance, if he is otherwise eligible.

4. In the result, the Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
