For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the petitioner on bail in the event of their arrest in crime No.0223 of 2023 on the file of the 2nd respondent police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the second respondent for the offences punishable under Sections 406, 420, 465, 467, 468 and 34 IPC in Cr.No.0223 of 2023 pending on the file of the second respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused had received huge amount from the de-facto complainant, by giving false promise to secure loan and thereafter, cheated him. Hence, the case.

3.The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in the case and he has nothing to do with the said allegations. He would further submit that Interstate Anticipatory bail may be granted to him to enable 1/2

CRL OP(MD). No.11346 of 2023 him to move to the appropriate jurisdictional Court in the State of Maharashtra for necessary relief.

4.Taking into consideration the facts and circumstances of the case, this Court is inclined to grant inter-state interim anticipatory bail to the petitioner for a period of six weeks from the date of receipt of a copy of this order to enable them to move to the concerned Court.

5.Accordingly, interim interstate anticipatory bail is granted to the petitioner for a period of six weeks, on condition that the petitioner shall surrender before the learned Judicial Magistrate No.V, Tirunelveli, within a period of fifteen days from the date on which the order copy made ready and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioner shall approach the competent Court in the State of Maharashtra and seek appropriate relief.

6. In view of the above directions, this Criminal Original Petition is disposed of.
