ORDER : The Court made the following order :- This petition has been filed to cancel the order of Anticipatory bail granted by the District and Sessions Judge, Tirunelveli, in Cr.M.P.No.10592 of 2019 vide order dated 23.01.2020.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (criminal side) for the first respondent.
3. The learned counsel for the petitioner / defacto complainant would submit that when the petitioner / wife is very much ready and willing to reunion with the second respondent herein / A1, the learned counsel for the second respondent / A1 represented that the second respondent was taking steps for reunion, but the petitioner / defacto complainant is not ready for the same and obtained anticipatory bail.
4. On perusal of the records revealed that the allegation as against the second respondent /A1 that demand of huge dowry and also other harassment and cruelty committed by the second respondent / 1/3
A1. In so far as the other condition imposed by the Court below is continuously complied by the second respondent (A1) herein. Therefore, the ground raised by the petitioner / defacto complainant, to cancel the anticipatory bail granted to the second respondent / A1, cannot be sustained and accordingly, this Petition is dismissed.
5. However, the petitioner / defacto complainant is now ready and willing to reunion with the second respondent (A1) herein. Considering the above submission, the second respondent / A1 is directed to appear before the Mediation and Conciliation Centre, Tirunelveli District on 06.01.2021. The petitioner / defacto complainant also directed to appear before the Mediation on 06.01.2021.
6. On their appearance, the District Mediation and Conciliation Centre, Tirunelveli District, is directed to explore the possibility of the petitioner / defacto complainant and the second respondent (A1) herein.
7. If the second respondent / A1 fails to appear before the District Mediation and Conciliation Centre, Tirunelveli District, the petitioner / defacto complainant is at liberty to file a petition for cancellation of anticipatory bail ordered to the second respondent (A1) herein.
