ORDER
This Civil Revision Petition has been filed by the petitioner to set aside the docket order dated 14.06.2023, passed in Unnumbered M.C.O.P.No.
Of (F.No.MCOP/1024/2022)(CNR 1/4
No.TNKR0100298822022) on the file of the Motor Accident Claims Tribunal, Karur.
2.The petitioner is aggrieved by the docket order dated 14.08.2023, seeking to return the claim petition filed by the petitioner on 13.09.2022, which was later re-presented on 21.12.2022, pursuant to which the impugned order has been passed.
3.The specific case of the petitioner is that the respondent State Transport Corporation also has its branch office within the jurisdiction of the Tribunal. The Tribunal empowers to proceed with the proceedings. 4.The learned counsel for the petitioner has placed reliance on the decision of the Hon'ble Supreme Court in the case of Malati Sardar v. National Insurance Co. Ltd., and others reported in 2016 (1) TNMAC 1 (SC) and that decision of this Court in the case of Oriental Insurance Co. Ltd., v. Muthumeenal and others reported in 2016(2) TNMAC 58. 5.However, reading of the re-presentation of the petitioner in the return indicates that the petitioner has not stated the aforesaid citations, 2/4
which he is placing reliance.
6.Considering the above, liberty is given to the petitioner to file appropriate application for numbering in accordance with provision of Act and after giving proper explanation.
7.With the above liberty, this Civil Revision Petition is dismissed. No Costs. The Registry is directed to return back the original petition papers.
