Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.T.LENINKUMAR, Advocate for the petitioner and of MR.M.SAKTHI KUMAR, Government Advocate(Crl.side) on behalf of the 1st Respondent and Mr.K.C.MANIYARASU, Advocate for the 2nd respondent, the Court made the following order:- 1/3

The learned Counsel for the petitioner/defacto complainant submits that earlier this Court in Crl.O.P(MD)No.6051 of 2024, has granted anticipatory bail to the accused by considering the nature of allegation and the enquiry was pending, on the file of the respondent police. However, during the course of enquiry, the petitioner was not provided an opportunity to submit his allegations. 2.It appears that till now, the respondent police has not registered a case as against the accused. Since there is no apprehension of arrest, there is no necessity for anticipatory bail and cancellation of anticipatory bail. 3.Accordingly, this petition is dismissed.
