Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent herein to assign the land in Kumbakonam Town, Ward No.6, S.F.No.2224/3 for an extent of 2532 sq.ft out of total extent of 7055 sq. ft. to the petitioner and consequently directing the respondent to grant patta in name of the petitioner by considering his representation, dated 27.12.2016 within the time fixed by this Hon'ble Court.

Mr.A.Muthukaruppan, learned Additional Government Pleader takes notice for the respondent.

2. By consent of parties, the main Writ Petition itself is taken up for final disposal.

3.The case of the petitioner is that he has been residing in the property comprised in Ward No.6, S.F.No.2224/3 of Kumbakonam Town, for more than 46 years. For the purpose of assigning the land in his favour, the petitioner had approached the respondent. Based on which, the respondent had sent a communication to the municipal corporation for giving 'no objection' for the petitioner's claim.

After that, there was no further improvement. Therefore, the petitioner was constrained to make a representation on 27.12.2016 to the respondent. Since the said representation was not considered so far, the present writ petition has been filed.

4. In view of the limited prayer sought for in this writ petition, without going into the merits of the claim made by the petitioner, there shall be a direction to the respondent to consider the petitioner's representation, dated 27.12.2016 and

pass appropriate orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No Costs.
