Prayer :- This Writ Miscelleneous Petition is filed under article 226 of the Constitution of India, to set aside the order passed by this Honble court in W.P.(MD) No. 21841/2017 dated 28.03.2019 in dismissing the writ petition for non-prosecution and to restore the same.

Prayer in WP(MD). 21841/ 2017 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Mandamus, directing the respondents to regularize the petitioners service from the date of his original appointment dated 21.07.1989 to 30.04.2010 with all service and monetary benefits and direction is also sought for to grant eligible pensionery benefits.

ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Ms. G.Dhiya Bharathi, Advocate for the Petitioner and of Mrs. D.Farjana Ghoushia, Special Government Pleader for the respondents, this Court made the following order:

"This Court is satisfied with the reasons contained in the affidavit filed in support of this application seeking to restore the writ petition, which was dismissed for non-prosecution by this Court on 28.03.2019. Learned Special Government Pleader appearing for the respondents has also not raised any serious objection for allowing this application. 2/4

Accordingly, this application is allowed as prayer for and the writ petition, namely, W.P.(MD) No.21841 of 2017 is restored to file."
