This Criminal Original Petition has been filed as against the 2nd respondent to comply the order in Crl M.P No. 1020 of 2022 on the file of the learned Judicial Magistrate No.1, Madurai dated 05.07.2022 and consequently, to register the First Information report. 2.The learned Counsel for the petitioner submits that the order passedby the learned Judicial Magistrate No.I, Madurai in Crl M.P No. 1020 of 2022 has not been complied with by the respondent police. 3.Considering the submissions made by the learned Counsel for the petitioner that the complaint which has been forwarded by the learned Judicial Magistrate, has not been attended by the respondent police, this Court has directed the Deputy Superintendent of Police, District Crime Branch, Madurai, to file a counter affidavit.
The Deputy Superintendent of Police, District Crime Branch, Madurai, has also filed a report that the complaint forwarded by the learned Judicial Magistrate No.1, Madurai, was duly enquired and the same was closed as money dispute, which is of civil nature.
complaint on 18.06.2024. According to the Deputy Superintendent of Police, it is purely a money transaction which is of civil nature, therefore, they have not registered a case.
4.The learned Additional Public Prosecutor has produced the report filed by the Inspector of Police, District Crime Branch, Madurai, before the learned Judicial Magistrate No.I, Madurai. 5.Considering the submissions made by the learned Additional Public Prosecutor, this Criminal Original Petition is closed with a direction to the respondent police to furnish a copy of the closure report to the petitioner, enabling him to workout his remedy in the manner known to law.
