ORDER
(Order of the Court was made by G.K. ILANTHIRAIYAN,J.) This Petition is filed to stay all further proceedings in pursuant to the judgment and decree dated 24.09.2024 M.C.O.P. No. 447 of 2023 on the file of the Motor Accident Claims Tribunal, Special District Court, Thanjavur, pending disposal of the Civil Miscellaneous Appeal.
2. The learned counsel for the claimant / first respondent herein submits that pending the appeal, this Court granted stay of award passed by the Tribunal in M.C.O.P. No. 447 of 2023 on the file of the Motor Accident Claims Tribunal, Special District Court, Thanjavur, on condition that the petitioner / appellant shall deposit 50% of the award amount along with proportionate accured interest and costs within a period of four weeks from the date of receipt of copy of the order. Failing which, the Civil Miscellaneous Petition shall stand dismissed automatically. He further submits that though this Court passed an order on 03.09.2025 and even after completion of stipulated time as fixed by 2/4
this Court, the petitioner / appellant failed to comply with the condition.
3. Therefore, it is clarified that if the petitioner / appellant failed to comply with the said condition, the stay granted by this Court dated 03.09.2025 stands automatically dismissed.
4. Accordingly, this Civil Miscellaneous Petition is disposed of. Mere pendency of the appeal, in the absence of any interim order, is not an impediment for the claimant to execute the award passed by the Tribunal in the manner known to law.
