... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 1st respondent to consider the petitioner's Passport Application in Ref. No.24-1001104211 dated 24.01.2024 and issue passport to the petitioner in accordance with law and for other reliefs.
For Petitioner : Mr.S.Harish For Respondents : Mr.V.Malaiyendran CGSC for R1 : Mr.A.Albert James Government Advocate (Crl.side) for R2 1/4
ORDER
Heard both sides.
2. The petitioner seeks issuance of passport.
3. The learned Government Advocate (crl.side) informs the Court that the petitioner was involved in Crime No.477 of 2016 registered on the file of the Dindigul Town North Police Station for the offences under Sections 143, 145, 341, 188, 285 of IPC. Investigation was concluded and final report has been taken on file in C.C.No.580 of 2016 on the file of the Judicial Magistrate No.2, Dindigul. Since the offences registered against the petitioner are rather minor in nature, I do not want to relegate the petitioner to go before the trial Court. Since the criminal case has been registered only on account of the petitioner's participation in agitation, it need not be put against him. The first respondent is directed to process the petition mentioned application and issue passport to the petitioner subject to fulfilment of other usual formalities. This may be done as expeditiously as possible.
4. With this liberty to the first respondent, the Writ Petition is allowed. No costs.
