Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 4 and 5 to return the 16 Kgs rice which was seized at the Mill of the 6th Respondent on 14.10.2016 and in consequently direct the 1st and 2nd Respondents to take appropriate disciplinary action against the 4th and 5th Respondents.

Mr.T.S.Mohamed Mohideen, learned Additional Government Pleader takes notice for the respondents 1 to 5.
2. The case of the petitioner is that on 08.10.2016, he purchased 16 Kgs of rice through his Ration Card and had given it to the sixth respondent's Rice Mill for polishing. Under these circumstances, the fourth and fifth respondents had conducted a raid in the sixth respondent's Rice Mill and seized the rice including the petitioner's rice. According to the petitioner, he purchased the rice through his Family Ration Card and had given it to the sixth respondent for the purpose of polishing. Hence, he had given a representation to the first respondent on 17.10.2016 ventilating his grievance, which according to the petitioner, has not been considered till date. Hence, the present writ petition has been filed.
3. Though the petitioner has sought for a larger relief seeking a direction to the fourth and fifth respondents to return his rice, the learned counsel for the petitioner submits that the petitioner would be satisfied if a direction to consider his representation dated 17.10.2016, is directed to be considered on its own merits.
4. In view of the same, without expressing any view on the claim made by the petitioner, there shall be a direction to the fourth respondent to consider the petitioner's representation, dated 17.10.2016, on its own merits and pass appropriate orders, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
With the above direction, the Writ Petition is disposed of. No Costs.
