ORDER
The above writ petition has been filed seeking a mandamus directing the 3rd respondent DEO to register forthwith M.Albert as the Correspondent of the petitioner school on the basis of the proposal dated 19.05.2022.
2. Christian Endeavor Literary Trust is the educational agency running C.E.Higher Secondary School and C.E.Primary School. One Mr.M.James was the correspondent of both the schools. By way of Resolution No.12/22 dated 17.05.2022, passed by the Trust, the said Mr.M.James was removed from the correspondentship. On the same date by way of Resolution No.13/2025, Mr.M.Albert was appointed as correspondent of C.E.Higher Secondary School and C.E.Primary School. 2/6
3. The correspondent has forwarded the said proposal to the 2nd respondent herein for recording the correspondentship. On 21.12.2022, the 2nd respondent has accepted the proposal with regard to C.E.Primary School and approved the correspondentship of Mr.M.Albert. However, so far orders have not been passed for approving the correspondentship of Mr.Albert to C.E.Higher Secondary School. Hence, the present writ petition.
4. According to the learned Additional Government Pleader appearing for the respondents, documents relating to the removal of Mr.M.James and appointment of Mr.M.Albert have not been produced. In support of his contentions, he relied upon Paragraph 5 of the counter which is extracted below:- "5. I respectfully submit that the byelaws of the Trust/Registered Society was not enclosed. Whether the remaining trustees are empowered to remove the existing Managing Trustee according the provisions in the byelaws are not established. And where is there is any change in the constitution of the Trust/Society, necessary Form VII is to be filed and the certificate from the Registration Department as to the filing of the Form VII is to be obtained, in as much as the Trust has been registered as a Society No.390 of 1994.
Thus the proposals received from the petitioner did not contain the vital facts and documents for consideration. If registered with Trust then Trust deed, then Association note/memorandum, Rules, and regulation with all the amendments should get attached. Mere resolution is not enough."
5. Heard the learned counsel on either side and perused the materials available on records.

The facts recorded above would clearly indicate that the respondents have accepted the correspondentship of Mr.M.Albert to EC Primary school based upon the same documents by issuing proceedings dated 21.12.2022. However, for the reasons best known, the authorities are yet to accept the correspondentship of Mr.M.Albert to the petitioner school which is a higher secondary school.

In view of the above said deliberations, the writ petition stands allowed with a direction to the 2nd respondent to register Mr.M.Albert as the correspondent of the petitioner school and pass orders within a period of eight weeks from the date of receipt of a copy of this order.
