ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 19.05.2026 and consequently forbearing the respondent from taking possession of the subject property in Survey No. 136/3, Bogalur Village, Paramakudi Taluk, Ramanathapuram District.
2. The case of the petitioner is that the petitioner's property comprised in Survey No. 136/3 was acquired by the second respondent for the purpose of laying National Highway. The acquisition proceedings were initiated through Gazette Notification dated 10.04.2019. Thereafter, the respondent issued a communication dated 19.08.2025, directing the petitioner to hand over possession of the property on the ground that the compensation amount had already been deposited in the petitioner's account. The petitioner has submitted a representation dated 19.05.2026 raising his objections and seeking appropriate relief. Since the said representation has not been considered, the present writ petition has been filed.
3. The learned Counsel for State of Tamil Nadu appearing for the 2/4
respondent submitted that once the compensation amount has been deposited, the petitioner ought to invoke the arbitration clause. However, the contention of the petitioner is that before directing him to hand over possession of the property through the communication dated 19.08.2025, the respondent ought to have considered his objections and afforded him an opportunity of hearing.

In view of the above, this Court is directing the respondent to consider the petitioner's representation dated 19.05.2026 and pass appropriate orders after affording the petitioner an opportunity of personal hearing, within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 04.06.2026 NCC : Yes / No Index : Yes / No Internet : Yes jbr 3/4
