PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to conduct survey on the petitioner's land situated in survey No.146/28 situated at A.Kokulam Village, Thirumangalam Taluk, Madurai District based on petitioner's representation, dated 26.12.2016 within a time frame stipulated by this Hon'ble Court.

Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader takes notice for the respondent.

2. By consent of parties, the main Writ Petition itself is taken up for final disposal.

3. The case of the petitioner is that she is the owner of the land in survey No.146/28 situated at A.Kokulam Village, Thirumangalam Taluk, Madurai District. On 26.12.2016, the petitioner had requested the respondent to survey and measure her land, which request was kept pending till date.

4. It is needless to point out that whenever an application for measurement and survey of the land is made, the respondent is duty bound to consider the same instead of keeping it pending. https://hcservices.ecourts.gov.in/hcservices/

5. In such circumstances, without expressing any opinion on the merits of the matter, there shall be a direction to the respondent to consider the petitioner's representation, dated 26.12.2016 and pass orders on merits and in accordance with law, also after hearing the rival claimants if any, within a period of six weeks from the date of receipt of a copy of this order. With the above direction, this Writ Petition is disposed of. No Costs.
