Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing respondent to grant permission to conduct Innisai Kacheri on 15.01.2017 at about 6 p.m. to 11 p.m. on the eve of Pongal Festival at R.C. School ground of Nambithalaipattayam Village, Nanguneri Taluk, Tirunelveli District.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondent to give necessary permission for conducting Innisai Kacheri on 15.01.2017 in the place mentioned in the petition, by way of issuing a writ of mandamus.

2.Mr.D.Muruganandam, learned Additional Government Pleader, has taken notice for the respondent.

3.It is seen from the records that on 10.01.2017 a representation has been given to the respondent for the purpose mentioned in the petition. But the respondent has not considered the same.

4.But the learned Additional Government Pleader appearing for the respondent has contended that the representation dated 10.01.2017 has been considered by the respondent and rejected mainly on the ground of law and order. Further it is represented on the side of the respondent that in the year 2014, during Innisai Kacheri, some known persons have assaulted the police. 5.Considering the aforesaid factual circumstances and also considering the fact that such occurrence has takenplace in the year 2014, this Court is of the view to give the following direction to the respondent.

6.In fine, this writ petition is allowed in part without costs and the respondent viz., Inspector of Police, Thirukurungudi Police Station is directed reconsider the representation dated 10.01.2017 and dispose of the same as early as possible.
