Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the order passed by the 3rd respondent by his proceedings in Na.Ka.No.15958/2015/A1 dated 03.12.2015, quash the same as arbitrary and illegal and consequently directing the respondents to issue patta for S.No.40/B1 in Silatur Village, Aranthangi Taluk, Pudukkottai District by considering the petitioner representation dated 12.07.2016.

Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

2. By consent, the Writ Petition itself is taken up for final disposal.

3. The petitioner challenged the order dated 03.12.2015, passed by the Tahsildar, Aranthangi Taluk in Na.Ka.15958/2015/A1, refusing to grant patta to the petitioner on the ground that the site for which petitioner sought for patta is classified as https://hcservices.ecourts.gov.in/hcservices/

'Vandipathai'. According to the petitioner, even though it is classified as 'Vandipathai', he wants reclassification of it as 'Natham' and he sought for patta.

4.In the circumstances, there is no infirmity in the order passed by the third respondent and there is no merit in the writ petition. However, the representation made by the petitioner, subsequent to the order of the third respondent, seeking for reclassification of the land as Natham and to grant patta to him is pending with the first respondent District Collector.

5. In the above circumstances, without going into the merits of the case, the first respondent is directed to consider the representation of the petitioner, dated 12.07.2016 and pass appropriate orders on the same, on merits and in accordance with law, after issuing notice to all the parties concerned, within a period of twelve weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No Costs. Consequently, connected Miscellaneous Petition is closed.
