ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus directing the respondents No. 1 to 4 to take appropriate action as against the respondents No. 5 and 6 based on the complaints preferred by the petitioner dated 02.04.2026 and 21.04.2026 in the light of section 22 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007 within the period that may be stipulated by this Court.

2. Learned counsel for the petitioner submitted that the petitioner is a senior citizen who is residing in his own house which is his self 2/5

acquired property. However, the 5th and 6th respondents who are none other than the petitioner's brother's wife and son, have trespassed into his house and taken possession over a portion of the house. In this regard, two civil suits, one filed by the petitioner and another filed by the 5th and 6th respondents, are pending. While so the 5th and 6th respondents are trying to dispossess the petitioner from the said house. In this regard, the petitioner has given a representation to the respondent police. Since, no action has been taken, seeking indulgence of this Court, this petition is filed.

3. The learned counsel for the petitioner also submitted that neither the petitioner nor the 5th and 6th respondents have obtained any injunction order against each other in the pending civil suits.

4. The learned Government Advocate submitted that the petitioner's representation is pending for enquiry in CSR No.118 of 2026 dated 30.02.2026.

5. Considering the age of the petitioner, it is made clear that the second respondent police should ensure that the petitioner is not dispossessed from the subject house till the disposal of the pending civil suits except in accordance with due process of law.
