ORDER

The petitioner has submitted an application for renewal of his passport and has also filed this writ petition for a mandamus directing the respondent to renew the petitioner's passport by considering his application dated 13.02.2023.

2.Learned Counsel for the petitioner submitted that a criminal case has been registered as against the petitioner in Crime No.73 of 2013 on the file of the Vasco Police Station, Goa and after investigation, the petitioner has been discharged from the said case. However, by referring the case, the respondent is not processing the petitioner's application. Therefore, he prayed for appropriate orders.

3.Learned Deputy Solicitor General of India for the respondent submitted that neither any materials nor the fact that the petitioner / accused was discharged from the criminal case was placed before the concerned authority by the petitioner. He further submitted that if the petitioner produces 2/4

all the relevant materials before the respondent, further decision would be taken after considering the documents.

4.In view of the rival submissions made, this writ petition is disposed of, with a direction to the petitioner to appear before the respondent on 19.07.2023 and produce all the relevant records, including the order of discharge in respect of Crime No.73 of 2013 on the file of Vasco Police Station, Goa, as claimed by him. On receipt of the same, the respondent shall consider the nature of allegation as against this petitioner and the other relevant materials and thereafter, pass appropriate orders within a further period of twelve weeks therefrom. There shall be no order as to costs. Index :
