Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the Respondent No.2 to conduct enquiry and cancel the fraudulent registration of document vide Document No.3819/1987 in respect of the petitioner's property to an extent of 39.0 Ares in S.No.43/1 , Sooriyur Village, Thiruverambur Taluk, Trichy District in accordance with the procedure contemplated in Circular 67 dated 03.11.2011 by considering the representation of the petitioner dated 14.03.2016 within the time period stipulated by this Hon'ble Court.

ORDER

The petitioner has filed this writ petition seeking a direction, directing the respondent No.2 to conduct enquiry and cancel the fraudulent registration of document vide Document No.3819/1987 in respect of her property to an extent of 39.0 Ares in S.No.43/1 , Sooriyur Village, Thiruverambur Taluk, Trichy District in accordance with the procedure contemplated in Circular 67 dated 03.11.2011, by considering her representation, dated 14.03.2016.

2. According to the petitioner, the disputed land was assigned to her in the year 2007. Later, she came to know that one Mr.Subramani already sold the land in favour of one Mrs.Lakshmi and the sale deed was also registered by the Sub Registrar, Thiruverumbur vide Doc.No.3819/87. In the above circumstances, 14.03.2016, she made an application to the second https://hcservices.ecourts.gov.in/hcservices/

respondent/District Registrar, Registration Department, Trichy District, to cancel the sale deed. So far, no order has been passed by the second respondent. Hence, she has filed the present writ petition.

3.Heard the learned counsel for the petitioner and Mr.V.Muruganandham, learned Additional Government Pleader, appearing for the respondents.

4.Since the petitioner's application has been pending from March 2016, the second respondent/District Registrar, Registration Department, Trichy District, is directed to conduct an enquiry, after giving an opportunity to the petitioner as well as the other concerned parties and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of copy of this order. At the time of passing orders, the second respondent is directed to consider the orders already passed by this Court. 5.With the above direction, the writ petition is disposed of. There shall be no order as to costs.
