ORDER : The Court Made the following order :- The petitioner/Accused apprehends arrest at the hands of the respondent police for the offences punishable under Section 12 (a) of Passport Act, in Crime No.not known of 2018, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner with an intention to cheat the passport authority, the petitioner has submitted false SSLC mark sheet. Hence, the complaint. 3.When the matter was taken up for hearing on 28.09.2018, the learned Additional Public Prosecutor would submit that petition enquiry is pending and hence, the matter was posted today for reporting compliance. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that the enquiry has been conducted and case has been registered as against the petitioners in crime No.44 of 2018 for the offences under Sections 420, 468, 471 of I.P.C. and Section 12(1)(a) of Passport Act.

submit that the petitioner is an innocent person and he has been falsely implicated in this case.

5.The learned Additional Public Prosecutor would submit that the investigation is pending.

6.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Theni and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 5..The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
