ID.No.53 of 1999 on the file of Labour Court, Madurai with full wages with effect from 15.09.2010 within a reasonable time as may be fixed by this Hon'ble Court.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.K.P.KRISHNADOSS, Special Government Pleader for the petitioners, the Court made the following order:- (Order of the Court was made by T.S.Sivagnanam, J.) We have heard Mr.K.P.Krishnadoss, learned Special Government Pleader appearing for the petitioners.
This petition has been filed to condone the delay of 740 days in filing the review petition.
We have perused the affidavit filed in support of the condone delay petition which consists of 7 paragraphs. Paragraphs 1 to 6 pertain to the various orders by the learned Single Bench and the judgment of the Division Bench. Paragraph 7 is stated to be the reasons as to why the review could not be filed in time. On perusal of the said paragraph, it is seen that the only statement is that the papers were sent to the higher officials for administrative sanction and after the sanction they approached the learned Special Government Pleader for opinion and thereafter the review has been filed and there is a delay of 740 days. There is absolutely no explanation for the inordinate delay. As the delay remains unexplained, we are not inclined to condone the same. Accordingly, the petition is dismissed.
