Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, praying for direction to grant permission and adequate police protection to celebrate the Dr.Ambedkar's 126th birthday anniversary on 14.04.2017 at Dr.Ambedkar Thidal, Dr.Ambedkar Mandram and the subsequent functions such as distributing sweets, conducting Annadhanam and welfare assistance to the needy poor downtrodden people, distribution of tricycle to the handicapped at Alli Muthu Nadal Kalyana Mandapam, Thiruchuli, Virudhunagar District based on the petitioner's representation dated 07.04.2017. ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to give necessary permission and also police protection for celebrating Dr.Ambedkar's 126th Birthday Anniversary on 14.04.2017 in the place mentioned therein, by way of issuing a writ of mandamus.

2.Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader, has taken notice for the respondents. 3.The learned Additional Government Pleader appearing for the respondents has drawn the attention of the Court to the order passed in W.P(MD)No.5630 of 2015 by this Court, wherein this Court has culled out certain conditions for celebrating the birthday of Dr.Ambedkar in the place mentioned in the petition. Further it is seen from the earlier order that time has also been stipulated from 10.00 a.m. to 02.00 p.m.

4.The learned counsel appearing for the petitioner has repeatedly contended to the effect that the time granted by the second respondent is not sufficient.

5.It is seen from the records that the second respondent has given a permission, wherein he permitted to celebrate birth anniversary of Dr.Ambedkar from 10.00 a.m. to 12.00 Noon. Considering the fact that in the earlier writ petition, time has been given from 10.00 a.m. to 02.00 p.m. and also considering the fact that the second respondent has already given permission, this Court is inclined to pass the following order.

6.In fine, the second respondent is directed to extend time till 02.00 p.m. by way of passing a separate proceeding. With the above observation, this writ petition is disposed of and further the petitioner is directed to abide the conditions imposed in the order passed in W.P(MD) No.5630 of 2015. No costs. Consequently, connected Miscellaneous Petition is closed.
