PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the 1st respondents to consider the petitioner's representation dated 15.04.2025 and consequently direct the 1st respondent to take necessary action against the 5th respondent. O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] This writ petition has been instituted seeking a direction to the first respondent to consider the petitioner's representation dated 15.04.2025 and consequently to direct the first respondent to take necessary action against the fifth respondent.

2. A reading of the representation submitted by the petitioner

shows that he has raised serious allegations against the fifth respondent - Advocate. Since no action has been initiated by the Bar Council of Tamil Nadu & Puducherry, the present writ petition came to be instituted.

3. Learned counsel appearing for the first respondent / Bar Council of Tamil Nadu & Puducherry submitted that the complaint has not been submitted in the prescribed format by paying necessary fee.

4. Learned counsel for the petitioner submitted that the petitioner has paid necessary fee, however, the complaint has not been submitted in a prescribed format.

5. Learned counsel appearing for the fifth respondent submitted the allegations raised by the petitioner are false and frivolous.

6. Be that as it may, the petitioner is at liberty to submit a complaint before the first respondent / Bar Council of Tamil Nadu & Puducherry in a prescribed format and on receipt of the complaint, the first respondent / Bar Council of Tamil Nadu & Puducherry is directed to look into

the same and initiate appropriate action in the manner known to law.

7. With the above observation, this writ petition is disposed of. No costs.
