Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the entire records pertaining to the ex-parte impugned order passed by the 1st respondent vide his proceedings in Pa.Mu.No.12557/N4/2016, dated 25.04.2016 and the consequential memo issued by the 3rd respondent in C.Pa.No.124/09 signed on 30.06.2016 and quash the same and further direct the 1st respondent to dispose of the petitioner's appeal paper, dated 29.08.2013 and pass speaking order by giving reasonable opportunity to him without considering the delay. ORDER

Against the order passed by the first respondent under Section 47(A)(5) of the Indian Stamp Act, the petitioner filed this Writ Petition.

2. Against the order passed by the Chief Controlling Revenue Authority under Section 47(A)(5) of the Indian Stamp Act, only an appeal will lie before this Court under Section 47(A)(10) of the Act. Hence, the petitioner cannot maintain a Writ Petition.

3. In view of the above, this Writ Petition is dismissed. However, liberty is given to the petitioner to file an appeal before this Court challenging the order passed by the first respondent. No Costs. Consequently, connected Miscellaneous Petition is closed.
