ORDER
The petitioner herein seeks a direction to the fifth respondent to act in accordance with the direction issued by the fourth respondent in his proceedings in O.Mu.(B-10) /41879/2024, dated 28.10.2024.
2.Heard the arguments of Mr.B.Vinothkumar, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 to 8. Since no adverse order is passed against the respondents 9 to 11, notice to the respondents 9 to 11 is dispensed with. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself. 3.The petitioner herein submitted a representation before the fourth respondent on 07.10.2024 seeking cancellation of the patta issued in favour of private individuals in respect of land classified as a water body in Survey Nos.40/5, 40/6 and 40/7 in Kodivayal Village, Thiruvadani Taluk, Ramanathapuram District.
The said representation was forwarded by the fourth respondent to the fifth respondent in his proceedings referred above, with a direction to consider the representation of the petitioner and take necessary action. Despite the direction issued by the fourth respondent, the fifth respondent has not conducted any enquiry and passed order. Therefore, the petitioner has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents 1 to 8 would submit that the representation of the petitioner is pending on the file of the fifth respondent and the same will be considered in accordance with law.
5.In view of the same, without expressing any opinion on the merits of the matter, the fifth respondent is directed to consider the representation of the petitioner dated 07.10.2024 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, private respondents 9 to 11 and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
