ORDER
This writ petition has been filed challenging the proceedings dated 15.05.2026, whereby the petitioner was placed under suspension pending enquiry on the allegation that the petitioner has sold the liquor at the price higher than the price prescribed by the respondent Corporation. The impugned proceedings specifically made a reference to the video, whereby the petitioner has entered into an argument with the customer and it is only basing upon a complaint accompanied by video, the petitioner was placed under suspension.
2. The only contention that is raised before this Court by the learned counsel for the petitioner is that no opportunity was afforded to the petitioner before placing him under suspension through the impugned proceedings.
3. In the considered opinion of this ourt, absolutely no opportunity need be afforded for placing an employee under suspension. It is not the 2/5
case of the learned counsel for the petitioner that the respondent lacks jurisdiction to place the petitioner suspension.
4. On the other hand, as per the Code of Prevention and Detention of Fraudulent Acts in Tamil Nadu State Marketing Corporation Limited, a specific power is conferred upon the respondents to place an employee under suspension pending enquiry.
5. In the circumstances, this Court does not find any reason to interfere with the impugned proceeding nor there is any error or illegality in the impugned proceedings. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
