W.P(MD).No.14777 of 2018: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to certificate of ineligibility dated 19.06.2018 issued by the 5th respondent and quash the same further direct the respondents to provide the MBBS admission for petitioner in MBBS course at any one of the Government College under physically challenged quota.

ORDER

This Court by order dated 23.04.2019, directed the Authorities to constitute a Medical Board for examining the writ petitioner and for issuing a disability certificate. The order passed by this Court has been complied with and a certificate dated 21.05.2019 had been issued.

2.The petitioner's counsel would state that the formal copy of the certificate is yet to be issued. The respondent is directed to issue the original certificate dated 21.05.2019, forthwith, without any delay. If the certificate had already been issued, proper acknowledgment has been taken from the writ petitioner. The petitioner had already scored eligibility marks in NEET Exam held last year. It is open to the petitioner, as to whether on the strength of the marks secured last year, the petitioner can get an entry for this year. Therefore, all the contentions of the petitioner are left open. It is for the petitioner to work out his remedy independently.
