This Criminal Appeal is filed under Section 14A(2) of the Schedule Casts and Schedule Tribes (Prevention of Atrocities) Act 1989, to call for the records relating to the impugned order passed by the Learned I Additional District and Sessions Judge (PCR) Thanjavur in Crl.M.P.No297 of 2025 dated 15.04.2025 and set aside the same. Order : This Criminal Miscellaneous Petition coming for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Arul Jenifer,Advocate for the Petitioner and of Mr.K.Gnanasekaran,Government Advocate(Criminal Side) for the Respondents 1 and 2, this court made the following order:

This Criminal Miscellaneous Petition filed to relax the conditions imposed against the petitioner in Crl.M.P.(MD). No. 6509 of 2025 in Crl.A(MD). No. 468 of 2025, dated 22.05.2025.

2.The learned counsel for the petitioner submitted that initially, while suspending the sentence, the petitioner was directed to stay at Thoothukudi and report before the Thoothukudi South Police Station, daily at 10:30a.m., and subsequently, it was modified through the order, dated 22.05.2025 in Crl.M.P(MD) No.6509 of 2025 to the effect that he has to sign before the Inspector of Police, Kumbakonam West Police Station, Thanjavur District on every Monday at 10.30a.m., until further orders.

3.The learned counsel further submitted that the accused had been complying the condition without any default. In view of the educational commitment of the petitioner, he seeks to relax the same.

4.The learned Government Advocate (Crl. Side) submitted that the petitioner has been complying the condition regularly and in this case, charge sheet has also been filed before the concerned Court.

5.Taking into consideration of the submissions made by both the counsels, I feel that the condition imposed on the petitioner can be relaxed. 6.Accordingly, this petition is allowed and the condition imposed on the petitioner to report the respondent Police/Inspector of Police, Kumbakonam West Police Station, Thanjavur District on every Monday is relaxed.
