ORDER

This Criminal Original Petition is filed to direct the first respondent to transfer the investigation of the above said case in Crime No. 501 of 2023 from the file of the third respondent police to CBCID / fourth respondent for further investigation and to file a final report before the concerned.

Learned counsel for the petitioner submitted that the petitioner is the defacto complainant, on his complaint a case in Crime No.501 of 2023 was registered by the third respondent police on 23.10.2023 on the suspicious accidental death of the petitioner's son. Since there is no progress in the investigation of the case, the present petition came to be filed seeking transfer of investigation.

3. The learned Government Advocate(Crl.side) submitted that it is a hit and run case. After the petitioner's complaint before the superior officer, an enquiry was conducted in all aspects and the case was closed.

4. Learned counsel for the petitioner submitted that despite statements from eye witnesses, it is too unfortunate on the part of the third respondent Police to drag on the investigation that they are not able to detect the car that was involved in the accident.

In this regard, the first respondent is directed to monitor the investigation conducted by the third respondent and the third respondent is directed to conclude the same within a period of four weeks from the date of receipt of a copy of this order and the third respondent is directed to appraise the progress of the investigation to the first respondent on every Friday. It is made clear that the investigation officer shall call upon the eye witness and obtain a statement from him with respect to the vehicle bearing registration No. TN 02 U 1290 Toyota Innova-Marun Red.

6. With the above directions, this Criminal Original Petition is disposed of.
