3.Kamaludeen 4.Abudhahir : Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first and second respondents to take appropriate action against the third and fourth respondents to stop their illegal construction in T.S.No.39/1A3(B) & T.S.No.39/2 in ward-C, Block11, Observatory Road, Kodaikanal, Dindigul District and consequently direct them to demolish the unauthorized construction put up by the third and fourth respondents, within the period stipulated by this Court.

*********** [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner has come up with this Writ Petition with a grievance that notwithstanding the representation submitted to the https://hcservices.ecourts.gov.in/hcservices/

Commissioner, Kodaikanal Municipality, action was not taken against the third and fourth respondents to stop the illegal construction made by them in T.S.No.39/1A3(B) & T.S.No.39/2 in ward-C, Block-11, Observatory Road, Kodaikanal, Dindigul District.

2. We have heard the learned counsel for the petitioner. We have also heard the learned Special Government Pleader appearing for the first respondent, the learned Additional Government Pleader appearing for the second respondent and the learned counsel appearing for the third and fourth respondents.

3. We direct the Commissioner, Kodaikanal Municipality, to consider and dispose of the representation submitted by the petitioner dated 14 October, 2016 on merits and as per law with notice to the third and fourth respondents. Such exercise shall be completed, within a period of three months from the date of receipt of a copy of this order.

4. The Writ Petition is disposed of with the above direction. No costs. Consequently, the connected miscellaneous petition is closed.
