PRAYER :- For Bail in Crime No.299 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 25.12.2022 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25, 27A and 29(1) of NDPS Act, 1985, in Crime No.299 of 2022 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 25.12.2022 at about 01.15 p.m., the de-facto complainant, while in his duty, he has received secret information that the petitioner along with his friends were taking contraband via Madurai to Thoothukudi road by car. Immediately, the de-facto complainant went to the occurrence place and recovered 22.300kgs of Ganja. Hence, the case. 3.Heard. Perused the materials available on record including the First Information Report.

4.It is seen that there are totally four accused involved in this case and the petitioner is arrayed as A2. All the accused persons were found in possession of contraband weighing 22.300kgs of Ganja. It is a commercial quantity. That apart, the petitioner has failed to satisfy the twin conditions as contemplated under Section 37 of the NDPS Act.

CRL OP(MD). No.11464 of 2023 5.Taking into consideration the gravity of the offence levelled against the petitioner, this court is not inclined to grant bail to the petitioner.
