Crime No.397 of 2018 : Respondents PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C. to direct the Inspector of Police, Tanjore Medical College Hospital Police Station, Tanjore District to add the additional penal provisions namely 420 and 406 of I.P.C. in the F.I.R. in Crime no.397 of 2018 registered by him and consequently direct him to file an alteration report in that connection before the Court concerned. ORDER

The criminal original petition has been filed to add certain penal provisions in the FIR registered in Crime No.379 of 2018. 2.The learned counsel for the petitioner would submit that the nature of allegations that have been made in the complaint attracts the provisions under Sections 420 and 406 IPC and the same has not been added in the FIR registered by the respondent police. 3.The learned Government Advocate (Crl.Side) for the respondents would submit that the case itself has been transferred to the District Crime Branch, Thanjavore on 10.09.2018 and the case is now investigated by the said police.

4.In the facts and circumstances of the case, the District Crime Branch, Thanjavore, is directed to proceed further with the investigation and if necessary materials are available in the course of investigation to constitute the offence under Sections 420 and 406 IPC, the same may also be added and investigated and a final report shall also be filed as expeditiously as possible. https://hcservices.ecourts.gov.in/hcservices/

5.This criminal original petition is disposed of with the above direction.
