Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records relating to the proceedings of the impugned order in Na.Ka.No.B6/34796/2021, dated 03.09.2021 on the file of the first respondent and quash the same.

ORDER

The Writ petition has been filed in the nature of Certiorari, questioning an order during the course of enquiry by the first respondent/District Revenue Officer, Ramanathapuram District, wherein, a stay which was granted by the officer was vacated. 2.I am informed today by Mr.Gandhiraj, learned Special Government Pleader that the order of vacating stay has now been withdrawn. This effectively means status-quo anti has been restored by the very same official. It would only be advisable that the petitioner herein, goes back to the first respondent to continue proceedings which is already pending before the first respondent.

3.Let me not enter into a discussion with respect to the merits, since, they are now under the purview of the first https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.16576 of 2021 respondent, who is the competent authority to examine the facts as presented by all the parties.

4.The Writ petition is dismissed since, effectively, there is no order of stay as on date.

5.The petitioner is directed to go back to the District Revenue Officer/first respondent, who may issue notice to all the parties, particularly, to the third respondent herein, fix a date for recommencing the hearing, and from that particular date dispose of the entire matter within a period of twelve weeks following principles in manner known to law.

6.With the above observation this Writ Petition is dismissed. No costs. Consequently, the connected Miscellaneous Petitions are also closed.
