ORDER
The petitioner has approached this Court seeking a direction to the respondents to remove the electricity pole erected on the petitioner's patta land comprised in Survey No.100/10C2, measuring an extent of 4 cents in Patta No.5227, situated at Thumbaipatti Village, Melur Taluk, Madurai District, in the light of the communication issued by the first respondent dated 27.02.2024 and by considering the petitioner's representation dated 02.01.2024. 2.The petitioner claims to be the absolute owner of the aforesaid property. According to him, the respondents have erected an electricity pole in his land for the purpose of providing electricity 2/5
service connection to an adjacent property. It is his specific case that the pole has been erected in the middle of his land, thereby preventing him from effectively using and enjoying the property. In these circumstances, the petitioner submitted a representation seeking removal or relocation of the electricity pole. The grievance of the petitioner is that no orders have been passed on the said representation till date.
3.The learned Standing Counsel appearing for the respondents submitted that the petitioner's representation would be considered and appropriate orders would be passed in accordance with law within such time as may be stipulated by this Court. 4.The said submission is placed on record.
5.In view of the above submission, and without expressing any opinion on the merits of the petitioner's claim, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 02.01.2024, in the light of the communication issued by the first respondent dated 27.02.2024, and pass appropriate orders on its own merits and in accordance with law, after affording an opportunity of hearing to all concerned parties. aforesaid exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
