PRAYER :- For Bail in Crime No.346/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 28.05.2022 for the alleged offences under Sections 394 of IPC, in Crime No.346 of 2021, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the defacto complainant lodged a complaint stating that on 11.10.2021, at about 09.00 a.m, when she was returning from the school, she was waylaid by the accused person and he snatched away 5 sovereigns of gold jewels. Because of the above said robbery, she has also sustained injury. Based upon the above said occurrence, complaint has been given and case has been registered against the accused. 3.After completion of investigation, final report has been filed before the learned Judicial Magistrate, Bodinayakanur and it was taken on cognizance in C.C.No.25 of 2022. 4.From the report by the concerned Court, it is seen that 15 witnesses have been examined and the case was posted to 05.09.2022 for examination of remaining witnesses.

CRL OP(MD). No.13816 of 2022 5.Seeking bail, this petition came to the filed on the ground that he is in custody for more than several months and trial is going to be over within a short period of time. 6.Considering the fact that the petitioner is involved in another Crime No.634 of 2017, if he released on bail, there is every likelihood of absconding.

7.The learned Government Advocate (Crl.Side) would submit that in the above said crime, PT warrant has also been issued against the petitioner.

8.Let the Trial Court complete the trial within a period of 15 days from the date of receipt of a copy of this order. The trial could not be completed within the above said period, the petitioner can move bail application before the concerned Court without referring the order that has been passed by this Court in this matter.

9.With the above direction, this Criminal Original Petition is dismissed.
