Respondents Prayer:- Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the 3rd respondent in pursuant to impugned order in Na.Ka.No.1487/Aa1/2017 dated 23.03.2017 and quash the same and consequently directing the 3rd respondent herein to conduct an enquiry and to take appropriate action on the basis of the Circular No.67 dated 03.11.2011 in respect of fraudulent transfers and registration vide Documents No.2192/2016 dated 07.04.2016, No.4197/2016 dated 14.07.2016 and No.6375/2016 dated 14.11.2016 pertaining to Survey No.457/1A1 at Pulivalam Village, Musiri Taluk, Trichy District.

ORDER

The prayer in the writ petition is to issue a Writ of Certiorarified Mandamus calling for the records of the 3rd respondent in pursuant to impugned order in Na.Ka.No.1487/Aa1/2017 dated 23.03.2017 and quash the same and consequently directing the 3rd respondent herein to conduct an enquiry and to take appropriate action on the basis of the Circular No.67 dated 03.11.2011 in respect of fraudulent transfers and registration vide Documents No.2192/2016 dated 07.04.2016, No.4197/2016 dated 14.07.2016 and https://hcservices.ecourts.gov.in/hcservices/

No.6375/2016 dated 14.11.2016 pertaining to Survey No.457/1A1 at Pulivalam Village, Musiri Taluk, Trichy District. 2.According to the petitioner, he was kidnapped by some persons and they forcibly obtained the sale deed dated 07.04.2016 registered in their favour. According to the petitioner, he has not received any sale consideration. In the said circumstances, the petitioner is said to have submitted a representation to the respondents on 16.03.2017 requesting them to take appropriate action for nullifying the fraudulent sale deed and sale agreement dated 07.04.2016 and 14.07.2016. In response to the representation, the third respondent passed impugned order dated 23.03.2017 directing the petitioner to approach civil forum for seeking appropriate remedy. Challenging the said impugned order dated 23.03.2017, the present writ petition is filed.

3. Heard the learned counsel appearing for the petitioner as well as the learned Special Government Pleader appearing for the respondents.

4. I am of the considered view that the 3rd respondent has rightly rejected the representation said to have been made by the petitioner and directed him to approach civil forum for seeking appropriate remedy. I do not find any infirmity in the order passed by the third respondent.

5. In the result, this writ petition is dismissed. No costs. Sd/- Assistant Registrar(CS-III) /True Copy/ Sub Assistant Registrar.
