PRAYER :- To modify the condition No.7(iii) imposed in Crl.OP(MD).No.6671 of 2025 dated 22.04.2025.

ORDER : The Court Made the following order :- This petition has been filed to modify the condition No.7(iii) imposed in Crl.OP(MD).No.6671 of 2025 dated 22.04.2025.

2. The learned counsel for the petitioner submitted that the petitioner has filed an anticipatory bail application before this Court on 07.04.2025 in Crl.OP.(MD). No.6671 of 2025. The said anticipatory bail petition was heard and on 22.04.2025, this Hon'ble Court was pleased to grant anticipatory bail to the petitioner with certain conditions. In the said anticipatory bail order, Para.7(iii) as follows: ''(iii). The petitioner shall appear and sign before the respondent police daily at 05.00p.m. until further orders.''

3. He further submits that the petitioner underwent surgery for Hernia on 15.05.2025 and later discharged on 19.05.2025, in addition to this the petitioner was diabetic patient. Since, due to the above condition imposed by this Hon'ble Court, the petitioner was not able to comply the said order. Hence, the petitioner seek indulgence of this court by modifying the said condition imposed against him. 2/4

Hence, he prays for modification of the said condition.

4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Miscellaneous Petition.

5. Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated in the accompanying affidavit, this Court is inclined to modify the Condition No.7(iii) in the order made in Crl.O.P (MD).No.6671 of 2025 dated 22.04.2025. Accordingly, Condition No.7(iii) is modified as ''(iii). The petitioner shall appear and sign before the Inspector of Police, Chinnakovilankulam Police Station, Tenkasi District weekly once, i.e., on every Monday at 10.30a.m. until further orders.''. The other conditions shall remain unaltered.
