S. O R D E R
This writ petition has been filed for issuance of writ of Certiorarified Mandamus calling for the records relating to the order passed by the 2nd respondent dated 15.07.2013 relating to the order passed by the 2nd respondent dated 16.07.2013 made in Na.Ka.AA5/10938/2011 confirming the order dated made in 04.03.2011 made in Na.Ka.A.7/6379-09 of the 2nd respondent and quash the same as illegal and consequently to direct the respondents 1 to 4 to cancel the patta now standing in the name of Respondents 5 to 67 as pattathars.
2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4.
3. Challenging the order passed by the second respondent dated 16.07.2013, the petitioner has already approached this Court in W.P.(MD) No.16737 of 2013. This Court by order dated 09.01.2017 dismissed the writ petition giving liberty to the power agent of the petitioner to file a fresh writ petition. According to the petitioner, since liberty is given he is before this Court seeking the relief stated supra.

On a perusal of the pleadings and materials available on record, it could be seen that the matter has been settled as early as in the year 2013 and there is no whisper in the entire affidavit filed in support of this writ petition as to why there is so much delay in approaching this Court. There has been no explanation from the petitioner as to why the earlier writ petition came to be withdrawn and the petitioner cannot take advantage of the liberty granted by this Court in the earlier proceedings for filing a fresh litigation on the issue which has already been settled in the year 2013.
5. In such view of the matter, without going into merits and demerits of the case, this writ petition is dismissed on the ground of latches and delay. No costs. Consequently, connected W.M.P.(MD)No.5531 of 2017 is also dismissed.
