ORDER
[Order of the Court was made by D.KRISHNAKUMAR, J.] This Review Application is filed against the order dated 10.01.2019 in W.A.(MD)No.36 of 2019 on the file of this Court. 2.According to the review petitioner, he made an application through certificate of posting for change of his date of birth within 5 years from the date of his appointment as per Rule 49 of Tamil Nadu Subordinate Service Rules. However, the Writ Court and the Appellate Court dismissed the claim of the petitioner.
3.The learned Additional Government Pleader appearing for the respondents disputed the certificate of posting produced before this Court and submitted that the review petitioner has filed the aforesaid document before this Court at the first instance, after the petition has been taken up upto the level of Writ Appeal. He further submitted that some other records show the date of birth of the petitioner as 15.06.1960, but the petitioner claimed his date of birth as 06.12.1963.
4.Heard the learned counsel on either side and perused the materials available on record carefully.
5.Considering the submissions made on either side, we are of the considered view that the review petitioner has not produced the certificate of posting either before the Writ Court or Appellate Court, only at the first instance, he has filed the same before this Court, which is unacceptable at all. We are not satisfied with the submission made by the review applicant. Hence, there is no error or illegality in the order passed in the Writ Appeal. Accordingly, this Review Application is dismissed. No costs.
