ORDER : The Court Made the following order :- The petitioner is in judicial custody since 14.08.2018 for the offences punishable under Section Man missing @ 364 and 302 I.P.C, in Crime No.51 of 2018, on the file of the respondent police. He seeks bail.
2.The case of the prosecution is that a man has been abducted by the petitioner along with two others and subsequently, they have murdered the deceased. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent. Based on the confession statement of Co-accused, he has been implicated as an accused no.2. He is in incarceration from 14.08.2018 onwards. Hence, he prays for grant of bail.
4.The learned Additional Public Prosecutor appearing for the respondent police submits that the investigation is pending. 5.Considering the facts and circumstances and also considering the period of incarceration of the petitioner, this Court is inclined to enlarge the petitioner on bail with certain conditions. https://hcservices.ecourts.gov.in/hcservices/
Accordingly, the petitioner is ordered to be released on bail, subject to the following conditions;
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Eraniel, Kanyakumari District.
(iii) the petitioner shall appear before the respondent police daily at 10.30 a.m until further orders.
